JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code, sections 41, 42 and 52 of the Indian Forest Act, 4(1)A, 21(1) of D.E. Act and 40(1) of Bihar Minor Mineral Concession Rules, 1972.

It is alleged that three trucks were intercepted loaded with stone chips.

It is submitted by learned counsel for the petitioner that the truck carrying the stone chips with valid permits and the trucks in question have been directed to be released in pursuance to the order passed by this Court in CWJC No. 21132 of 2014. The petitioner is simply owner of the trucks and the trucks in question are used as public carrier. A statement has been made in

Patna High Court Cr.Misc. No.15911 of 2015 (2) dt.17-04-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Agrer) P.S. Case No.1128 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
