JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,341,323,324,325,307,504,506 and 379 of the Indian Penal Code.
It is alleged that on protest being made by the informant for being abused by the petitioner, the petitioner ordered to kill when Farjana Khatoon assaulted the informant with lathi when the son of the informant Md. Sahjade came to rescue, he was assaulted twice by the petitioner with Farsa.
It is submitted by the learned counsel for the petitioner that except uprooting of the tooth which has been opined to be grievous injury, other injuries have been found to be simple. There
Patna High Court Cr.Misc. No.14614 of 2015 (2) dt.11-05-2015 2/2 is counter version of the occurrence where the petitioner also received injury. It is further submitted that the informant has retracted from the initial version. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Nanpur P.S. Case No. 268 of 2014 pending in the court of learned SDJM, Pupri at Sitmarhi.
This application is disposed of with the aforesaid observation/direction.
