The petitioner seeks bail in Gaighat (Benibad OP) P.S. Case No. 67 of 2020, registered for the offence punishable under Section 394 of the Indian Penal Code.

As per the prosecution case, while the informant, his mother, brother were returning from Katra on car and reached near gas agency, two miscreants riding on black colour Pulsar motorcycle intercepted and fired upon the brother of informant and also snatched cash of Rs. 15,000 and bag containing documents.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Roushan Kumar who has already been granted bail by this Court vide

Patna High Court CR. MISC. No.48250 of 2021(2) dt.23-11-2021 2/2 order dated 04.09.2020 passed in Cr. Misc. No. 22746 of 2020 vide Annexure-2. No incriminating article has been recovered from possession of this petitioner. No test identification parade has been held till date. Petitioner is in custody since 06.07.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 15th, Muzaffarpur in connection with Gaighat P.S.
