2. The petitioner apprehends his arrest in connection with Complaint Case No. 1308 of 2023 registered for the offence under Section 498(A) of the Indian Penal Code and under Section 4 of the D.P. Act.

3. As per the prosecution case, the petitioner is said to have abused and assaulted his wife for demand of dowry.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the petitioner is also paying a maintenance amount of Rs. 5500/-

Patna High Court CR. MISC. No.37238 of 2026(2) dt.15-06-2026 2/3 which has been ordered by the Court of Principal Judge, Family Court Katihar in Maintenance Case No. 310 of 2024 as interim maintenance.

5. Considering the nature of allegation levelled against the petitioner, this application is allowed.

6. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court below in connection with Complaint Case No. 1308 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.

7. The Principal Judge, Family Court, Katihar is directed to conclude the proceedings of Maintenance Case No. 310 of 2024 within three months from the date of communication of a copy of this order.

8. Till the disposal of the maintenance case, the petitioner is directed to pay the interim maintenance of Rs. 10,000/- for maintaining his wife and child which includes Rs. 5500/- as interim maintenance granted by the Court below.
