The petitioner apprehends his arrest in Simari P.S. Case No. 183 of 2014, registered for the offences punishable under Sections 406, 409 and other Sections of the Indian Penal Code. The petitioner is alleged to have purchased solar lights from the company which is not earmarked by the State of Bihar. Learned counsel for the petitioner submits that petitioner is former Mukhiya of the Panchayat. The petitioner did not defalcate any amount. The petitioner did not receive any instruction from Panchayati Raj department for purchasing the solar lights either from BELTRON or from BREDA. Earlier also case of similar nature being Simri P.S. Case No. 46 of 2010 was filed in which the petitioner has already granted bail.

No.13657 of 2015 (2) dt.12-05-2015 2/2 Considering the facts aforesaid the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Simari P.S. Case No. 183 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
