JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 1.12.2015 in a case registered for the offences punishable under Sections 20 and 22 of NDPS Act and sections 25(1-B) a, 26 and 35 of the Arms Act.

The prosecution case is that the petitioner along with one Manish Kumar were apprehended. From the possession of Manish four kilograms of ganja and from the possession of the petitioner a loaded country made pistol were recovered. It is submitted by the learned counsel for the petitioner that the ganja was not recovered from the possession of the petitioner though a wrong statement has been made in paragraph 7 of the petition. Patna High Court Cr.Misc. No.20909 of 2016 (2) dt.10-05-2016 2/2 make necessary correction in the petition, as prayed for. The petitioner is accused on Hajipur Town P.S. Case No. 262 of 2014 though statement has not been made in paragraph 3 of the petitioner whether the petitioner is on bail in the aforesaid case or not. The investigation has already concluded. Considering the nature of recovery and the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Addl. District and Sessions Judge cum Special Judge, NDPS Act, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 847 of 2015.

Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on three consecutive occasions.
