This application for anticipatory bail arises out of Mufasil P.S. Case No. 340 of 2018, disclosing offences under Sections 420, 467, 468 and 471 of the Indian Penal Code. The allegation against the petitioner is that on the basis of forged and fabricated certificate, he secured appointment as Agriculture Co-ordinator in Gram Panchayat Srimatpur and Shankarpur under Block-Sadar of Munger District.

Learned counsel, appearing on behalf of the petitioner, has submitted that the petitioner's engagement as Agriculture Co-ordinator has been terminated. He also submits that it is wrong to say that the petitioner had submitted the certificate for his engagement, which was forged and fabricated. According to her, since the allegation against the petitioner is based on documentary evidence, there is no chance of the petitioner tampering with the investigation, if he is allowed the

In view of aforesaid submission, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned CJM, Munger in connection with Mufasil P.S. Case No. 340 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
