JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,341,323,307,353,427,504 and 120B of the Indian Penal Code. The prosecution case is that the informant Dr. Shahid Nazmi being a doctor has alleged that on 21.2.2016 at about 2 P.M. some people brought a patient with electric shock. The informant examined the patient and declared him dead. Thereafter, patient's attendant took him to the clinic of Dr. R.P. Sinha where the compounder of Dr. Sinha, namely, Bahadur told that the patient is alive, thereafter the mob got enraged and assaulted the informant and took away the computer monitor. Patna High Court Cr.Misc. No.20265 of 2016 (2) dt.09-05-2016 2/2 the police the accused persons escaped from the scene though the alleged patient was also declared dead by the doctor of Sadar hospital.

It is submitted by the learned counsel for the petitioners that the accusation is against the mob and the informant has not sustained any injury. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Barauli P.S. Case No.37 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
