JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The basic accusation is of torture and performing second marriage.

It is submitted by learned counsel for the petitioner that petitioner admits his marriage with the informant. The informant's side came to the house of the petitioner, made assault and on pistol point asked the petitioner to give Talak to the informant three times which led to the filing of Complaint Case No. 1982 of 2015 on 25.11.2015 by the petitioner against the informant's side and thereafter the present F.I.R was registered on 13.01.2016.

Considering the case lodged by the petitioner's side at earlier point of time, let the petitioner, above named, in the event of his arrest or surrender before the Court

Patna High Court Cr.Misc. No.19606 of 2016 (2) dt.03-05-2016 2/2 below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. Case No. 9 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
