JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Kotwali (Barari) P.S. Case No. 65 of 2020, registered for the offence punishable under Section 376(AB) of the Indian Penal Code and section 4/6 of the POCSO Act.

As per the prosecution case, petitioner is alleged to have committed rape upon the minor daughter of informant. It is submitted that petitioner has falsely been implicated in this case. Informant is not eye-witness of the occurrence. Petitioner is in custody since 01.02.2020 having clean antecedent.

On the last occasion, vide order dated 22.11.2021,

Patna High Court CR. MISC. No.47673 of 2021(3) dt.07-01-2022 2/2 report was called for regarding the stage of trial and same has been received (kept at flag 'A'), which reveals that charge has already been framed on 20.03.2021 and case is running for evidence.

Considering the nature of accusation and stage of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
