JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325 and 504 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The accusation is of pushing the informant causing fracture injury and abusing by calling caste name. It is submitted by learned counsel for the petitioner that no injury was caused to the informant. A statement to that effect has been made in para 8 of the petition. Moreover, for the occurrence of 20.11.2014, the FIR was registered on 22.11.2014 which was received before the learned court below on 24.11.2014. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.7485 of 2015 (2) dt.26-02-2015 2/2 Considering the delayed lodging of the case and statement made in para 8 of the petition to the effect that informant has not received any injury, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Korha P.S. Case No. 191 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioner shall be accepted by the learned court below after verification of the fact that no injury was actually caused to the informant.

If any injury will be found then the petitioner will surrender before the learned court and pray for regular bail. (Dinesh Kumar Singh, J) Amrendra/- U T
