JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Baikunthpur P.S. Case No. 158 of 2021, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have given Bhala blow on the head of informant's brother on account of which he became unconscious and succumbed to the injuries.

It is submitted on behalf of the petitioner that though there is specific allegation of assault is against petitioner, but doctor has found all the injuries caused by hard and blunt substance. Petitioner is in custody since 07.06.2021. Counsel for informant however, vehemently opposed

Patna High Court CR. MISC. No.47636 of 2021(3) dt.07-01-2022 2/2 the prayer for bail and submitted that there is specific allegation against this petitioner causing Bhala injury upon the deceased and the doctor has found lacerated wound on the body of deceased.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
