The petitioner seeks anticipatory bail in connection with Khagaria (Gangaur) P.S. Case No. 651 of 2012 registered for the offence punishable under Section 304-B read with 34 of the Indian Penal Code.
It is contended that there is no truth behind the allegation of demand of dowry. As a matter of fact, the deceased had committed suicide. It is pointed out that the father-in-law of the deceased has already been granted regular bail vide order dated 24.10.2013 passed in Cr. Misc. No. 18733 of 2013.
Patna High Court Cr.Misc. No.12348 of 2015 (4) dt.30-07-2015 2 / 2 Learned counsel for the State has opposed the prayer for bail. He has submitted that there is allegation of demand of dowry and subjecting the victim to cruelty for non-fulfilment of the same. The witnesses have supported the prosecution case in course of investigation. It is further contended that despite all coercive steps, the petitioner has evaded to appear before the court and the police has submitted charge sheet declaring the petitioner as an absconder.
Regard being had to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected.
