For the Petitioner/s : Mr. Diwakar Sinha, Adv. For the UOI : Mr. Kumar Priya Ranjan, Adv. =========================================================== CORAM: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI and HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL JUDGMENT (Per: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI) Date: 18-01-2018 O.A. application of the petitioner filed before the Cenral Administrative Tribunal, Patna Bench Patna has been dismissed on 04.08.2017.
The primary reason while the Central Administrative Tribunal, Patna Bench Patna has refused to grant any relief was for the fact that the recruitment process for selection on the post of Junior Engineer under 25% quota was cancelled and the recruitment process aborted in the year 2014. It was this decision of the year 2014 that the petitioner wanted to challenge in the year 2017 through the O.A. application.
Patna High Court CWJC No.1140 of 2018 dt.18-01-2018 2/2 The Tribunal has rightly refused to exercise power on an otherwise dead issue. The petitioner was well aware of the cancellation of the examination in the year 2014 itself. If that be so there was no occasion for the Tribunal to get into reasons for such cancellation in the year 2017.
We do not find any issue to interfere with the order of the Tribunal. Writ is dismissed.
