JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 408/409/34 of the Indian Penal Code.

It is alleged that the petitioner being the Panchayat Secretary did not hand over the charge of the various registers in the year 2013.

It is submitted by learned counsel for the petitioner that that the petitioner has handed over the charge. Considering the nature of accusation, let the above named petitioner be released on provisional anticipatory bail for four months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties

Patna High Court Cr.Misc. No.11237 of 2015 (2) dt.28-04-2015 2/2 of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Bihiya P.S. Case No.231 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

In the meantime, the learned court below call for a report from the office of the SDO, Bhojpur, Ara about hading over the charge. The provisional bail of the petitioners shall be confirmed if it transpires from the report of the SDO, Bhojpur, Ara that the petitioner has handed over the charge, otherwise the petitioner will surrender and pray for regular bail.
