The present application has been filed for initiation of a contempt proceeding against the Opposite Parties for willful violation of order dated 18.8.2017 passed by a Division Bench of this Court in CWJC No. 5875 of 2016, whereby this Court directed to remove the encroachment within a period of six months.
A show-cause dated 22.1.2019 on behalf of O.P. Nos.
Patna High Court MJC No.3262 of 2018(4) dt.23-01-2019 2/2 2,4 and 5 has been filed. In paragraph 12 of the show-cause, it has been stipulated that the order of this Court has been complied with and the encroachment has been removed. Paragraph 12 of the show-cause reads as follows: "That it is humbly submitted that on the date fixed i.e. 01.11.2018, the encroachment from the public land in question bearing Khata No. 360, Plot No. 3515,3532 and 3802 of Mauza - Tetaria, Thana No. 972, P.S. +Anchal- Deo, District - Aurangabad has been removed in presence of C.O. Deo, S.H.O., Deo P.S., Anchal Amin, C.I. and Halka Revenue K.C. and villagers also and after removal of encroachment from the public land in question, a proceeding was prepared on the spot which has signed by all concerned."
In view of the above stand of the O.P. Nos. 2,4 and 5, there is no need for proceeding further in the matter. This application is, accordingly, disposed of. (Dinesh Kumar Singh, J) ( Anil Kumar Upadhyay, J) anil/- U
