2. The petitioner seeks bail in connection with Mahnar P.S. Case No. 34 of 2024, dated 14-02-2024, instituted for the offence punishable under Sections 304, 313 and 34 of the Indian Penal Code.

As per the prosecution, an FIR has been lodged against three named accused, including the present petitioner, on the basis of allegations made by the Incharge Medical Officer that they conducted illegal abortion in connivance with others, which ultimately led to the death of one Juli Devi. 4.Learned counsel for the petitioner submits that the petitioner is innocent and she has been falsely implicated in the present case. It is further submitted that the FIR was lodged by

Patna High Court CR. MISC. No. 37363 of 2025(2) dt.18-06-2025 2/2 the Incharge Medical Officer, whereas the deceased's husband does not support the prosecution version. It is further submitted that a compromise petition (Annexure-P3) has been jointly filed by the petitioner and the husband of the deceased, Juli Devi, stating that the petitioner was neither aware of nor involved in the alleged incident. It is clarified in the compromise petition that the deceased, Juli Devi, died on the way to the hospital while being taken for treatment. The petitioner has been in custody since 23.04.2025 and one criminal case is pending against him.

5. Learned A.P.P. has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and nature of allegation levelled against the petitioner, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Hajipur, Vaishali, in connection with Mahnar P.S. Case No. 34 of 2024,.

7. The application stands allowed.
