The petitioner seeks bail in a case registered for the offence under Section 302 and other allied sections of the Indian Penal Code.

As per the prosecution case, two miscreants riding on motorcycle came to the shop and demanded rangdari and on refusal, they fired upon the brother of informant and fled away. During treatment, brother of informant died.

It is submitted on behalf of petitioner that petitioner is not named in the FIR. Name of the petitioner has transpired on the basis of confessional statement of co-accused Manoj Kumar, who has already been granted bail, vide order dated 13.12.2021 passed in Cr.Misc. No. 43456 of 2021. It is further submitted

No.47171 of 2021(2) dt.13-01-2022 2/2 that only material, which has come during course of investigation, against the petitioner is that this petitioner also used to demand rangdari in association with other accused persons. Till date, T.I.P. has not been conducted and petitioner is in custody since 25.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Sitamarhi P.S.
