2. Petitioner seeks pre-arrest bail in connection with Tiyar P.S.Case No.09 of 2025 registered for the offences punishable under Sections 191(2), 191(3), 115, 126(2), 109, 308(5), 352 and 351(2) of BNS.
3. As per the allegation made in the FIR, the petitioner along with the other co-accused persons demanded extortion money of Rs.50,000/- from the informant and upon refusal, they fired upon him but the informant escaped.
4. Learned counsel appearing on behalf of the petitioner submitted that the specific allegation against the petitioner is that he has fired upon Ashish Kumar Choubey, who escaped. Petitioner has clean antecedent. Another co-accused,
Patna High Court CR. MISC. No. 37114 of 2025(2) dt.16-07-2025 2/3 Golden Yadav, against whom similar allegation has been made has been granted pre-arrest bail, vide order dated 15.05.2025 passed in Cr. Misc. No.27603/2025.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

Having considered the rival submissions made on behalf of the parties, as well as, the allegation made in the FIR, I find that the petitioner is aged about 20 years and appears to have entered into the world of the crime, however, considering that the allegation against the petitioner is only that he had demanded extortion money and fired on Ashish Kumar Singh, who escaped. The allegation can not be sustained. The petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the learned district court within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM IX, Bhojpur at Ara/concerned court, in connection with Tiyar P.S.Case No.09 of 2025 subject to conditions as laid down under Section 482(2) of BNSS of 2023
7. The learned district court is directed to verify the criminal antecedent of the petitioner and if it is found that the
