Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 118(1), 109, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 23-10-2025 his mother (Meena Devi) was assaulted on account of a land dispute by Rajesh, his wife, Ritesh and Munni Kumari, it is next alleged that on 24-10-2025 when the informant questioned the accused that as to why they assaulted his mother,

No.36985 of 2026(2) dt.15-06-2026 2/3 Rajesh again assaulted his mother by a spade on head causing injury and thereafter also assaulted her on her back on account of which she became unconscious, thereafter Chandra Bhushan assaulted informant's father with an axe causing injury on hand, while Suman and Munni assaulted informant's father by a stick, it is further alleged that Ritesh assaulted the informant by a spade on his chest causing injury and the accused also took away Rs. 20,000/- and ornaments. 4.

Learned counsel for the petitioners submits that petitioners and the informant are related and are having dispute relating to land as such the informant falsely implicated the petitioners in the instant case. It is next submitted that there was a dispute in between the informant and his father on account of which an altercation took place and the informant tried to assault his father when his mother intervened but was pushed on account of which she fell and thus sustained injury but then informant took the same as an opportunity to implicate the petitioners in the instant case. It is further submitted that injury suffered by the informant and his father has been opined to be simple in nature and injury of the mother on head has been opined to be grievous but then the said injury was not caused on account of assault but on account of fall. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners and submits that there is a specific allegation against Rajesh of assaulting the mother of the informant on head by a spade causing grievous injury on head which is a vital part

After hearing the learned counsel for the parties, the petitioner nos. 2 and 3 above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mahnar P.S. Case No. 432 of 2025 subject to the conditions as laid down under Section 482

(2) of the BNSS.

However, the Court is not inclined to extend the privilege of anticipatory bail to petitioner no. 1 (Rajesh Kumar Suman).

Accordingly the anticipatory bail application is partly allowed.
