JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-07-2023 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 365, 370, 379, 506, 34 of the Indian Penal Code.

The F.I.R named accused persons are alleged to have abducted the informant's wife on the point of pistol and tried to sell her in Utter Pradesh for Rs. 2,00,000/- in collusion with other accused persons. It is also alleged

Patna High Court CR. MISC. No.42092 of 2023(2) dt.21-07-2023 2/3 that the accused persons have snatched the smart phone and cash of Rs. 10,000/- and jewelry of the wife of the informant.

It is submitted by learned counsel for the petitioners that petitioner are innocent and they have falsely been implicated in this case in the background of land dispute between the parties. The petitioners have no role in the abduction/kidnapping of the wife of the informant and during investigation also, no substantial material evidence has come to connect the petitioners with the aforesaid crime. The petitioners are languishing in custody since 02.09.2022. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial
