JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Kudhani P.S. Case No. 47 of 2020 corresponding to Trial No. 2998 of 2020, registered for the offence punishable under Section 414/34 of the Indian Penal Code and section 30(a), 38(i) and 41(i) of the Bihar Prohibition & Excise Act.

Earlier the bail application of petitioner was rejected vide order dated 29.01.2021 with an observation that if the trial is not concluded within six months, the petitioners may renew their prayer for bail.

It is submitted that till date trial has not been concluded and three chargesheeted witnesses are yet to be examined. Petitioners are in custody since 25.01.2020 having clean
