JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-05-2015 Heard learned counsel for the petitioner and the State.

Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 307, 379, 341, 342, 448, 504/34 of the Indian Penal Code. It is alleged that the petitioner along with coaccused Bhagwan Sahani and 5-6 unknown came to informant and petitioner assaulted the informant with iron rod on his head causing bleeding injury, co-accused Bhagwan Sahani assaulted to the informant by iron rod and other accused persons assaulted by lathi. When the informant's father came to rescue, then the accused persons also assaulted him. The petitioner and co-accused Bhagwan Sahani snatched Rs. 5,000/- from the pocket of the informant

Patna High Court Cr.Misc. No.15678 of 2015 (2) dt.04-05-2015 and petitioner also took money of Rs. 2,000/- from the pocket of the informant's father.

It is submitted by the learned counsel for the petitioner that injury has been found to be simple and for the occurrence of 22.11.2014 First Information Report was registered on 01.12.2014. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Keeping in view of the delayed lodging of the F.I.R. and there is no accusation of repeating the blow, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Motihari Muffasil (Lakhaura) P.S. Case No. 421 of 2014, pending in the court of learned Chief Judicial Magistrate, Motihari, East Champaran.

With this observation this application is disposed of.
