The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 436 of the Indian Penal Code.

It is alleged that either of two accused persons lit fire on the roof of tyre shop of the informant.

It is submitted by learned counsel for the petitioner that the informant has tyre repair shop and fire was lit by either of two accused persons including the petitioner but it is not specifically mentioned in the F.I.R. that as to who lit fire on the roof of the shop of the informant. There is counter version of occurrence also and the petitioner received injury by the informant' side. A

Patna High Court Cr.Misc. No.11153 of 2015 (2) dt.18-03-2015 2 / 2 statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that accusation is not specific against the petitioner and statement made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Parbatta P.S. Case No. 16/2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.

Khagaria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
