The petitioner apprehends his arrest in a case registered under Section 302 and other sections of the Indian Penal Code and Section 27 of the Arms Act.
According to the prosecution case, Ravindra Kumar alleged that Jagdish Yadav, Brijnandan Yadav, Sidheshwar Yadav, Rambabu Yadav and Mahesh Yadav came at his house and made firing. On the order of Jagdish Yadav, co-accused Yogendra Yadav, Sudama Yadav, Nageshwar Yadav and Chanarik Yadav came there and Yogendra Yadav assaulted the father of the informant with iron rod on his head. Dhananjay Yadav, Sudama Yadav and Brijnandan Yadav indiscriminately assaulted his father. Brijnandan Yadav assaulted the father of the informant with the
Patna High Court Cr.Misc. No.6782 of 2015 (2) dt.19-02-2015 2/2 butt of the gun. Thereafter, the informant alleged that other accused persons including the petitioner came and damaged the property in the village.
It appears that the petitioner is named at the fag end of the F.I.R. The petitioner is not the assailant of the deceased. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jehanabad in Kako P.S. Case No. 189/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
