The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,307,325 and 504/34 of the Indian Penal Code. The prosecution case is that the informant's brother in law (petitioner no. 1) came and started abusing her husband, when protest was made, thereafter petitioner nos. 2 and 3 came and assaulted the husband of the informant with lathi, danda and rod. When the son of the informant came to rescue he too was assaulted.
Patna High Court Cr.Misc. No.19827 of 2016 (2) dt.04-05-2016 2/2 It is submitted by the learned counsel for the petitioners that in the background of land dispute the accusation has been levelled. Petitioner no. 1 is brother in law (Devar) of the informant and petitioner nos. 2 and 3 are sons of petitioner no.1. Though one of the injuries of the husband of the informant namely Markandey Yadav has been found to be grievous but regard being had to the genesis of the occurrence and Statement made in paragraph 3 of the petition that the petitioners have no criminal antecedent, it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Durgawati P.S. Case No. 70 of 2016 pending in the court of learned CJM, Kaimur (Bhabua).
This application is disposed of with the aforesaid observation/direction.
