JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 379, 420, 406 and 504/34 of the Indian Penal Code.

It is alleged that the petitioner executed mortgage deed in the year 1999 with regard to land in favour of informant, subsequently, in the year 2005, the petitioner further took `96,000/- for executing final sale deed but neither the sale deed was executed nor the money was returned.

It is submitted by learned counsel for the petitioner that for the cause of action arisen in the year 1999-2005, the FIR has been lodged in the year 2014 and there is no proof with regard to payment of money by the informant to the petitioner. Considering the nature of accusation, let the above
