The petitioner apprehends his arrest in connection with Ekchari P.S. Case No. 7 of 2014 registered for offences punishable under Sections 341, 323, 354, 504/34 of the Indian Penal Code.

It is submitted that present case is an after thought as the petitioner had already made a complaint on 16.6.2014 vide Annexure 2 before the Sarpanch of Mohanpur Panchayat for taking appropriate action making allegation that he and his brothers have caught Shila Devi raid handed while plucking vegetables from the field of the petitioner in the night of 15.5.2014. Patna High Court Cr.Misc. No.38048 of 2014 (2) dt.04-03-2015 2/2 been lodged by the husband of Shila Devi on 17.6.2014 for the alleged occurrence of 15th June 2014 which appears to be after thought only for harassing the petitioner.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Karu Mandal be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Ikchari P.S. Case No. 7 of 2014, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri V.N.Prasad, Judicial Magistrate 1st Class, Bhagalpur subject to the conditions as laid down under subsection(2) of Section 438 of the Code of Criminal Procedure.
