2. In this case, the petitioner is seeking regular bail in connection with Goraul P.S. Case No. 6 of 2023, registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per allegation, when the informant with his son on his motorcycle was returning to home after closing his shop, three persons on motorcycle stopped his motorcycle and took out pistol and started indiscriminate firing. It is further alleged that three bullets hit his son near his arm, chest and thigh and one bullet hit the informant in his left thigh causing injury.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. Nothing
Patna High Court CR. MISC. No.45063 of 2024(2) dt.02-07-2024 2/2 has been recovered from his possession. His name has figured in confessional statement of co-accused. He is under custody since 24.01.2024.
5. On the other hand, learned APP has opposed the prayer for bail and submitted that the petitioner has involved in as many as 8 criminal cases to which the learned counsel for the petitioner replied that in this case there is nothing against the petitioner.

Considering the above-mentioned facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hazipur in connection with Goraul P.S. Case No. 6 of 2023, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
