Heard learned counsel appearing on behalf of petitioner and learned A.P.P. appearing for the State through video conferencing.

This application is filed for modification of order dated 23.03.2021 passed in Criminal Miscellaneous No. 34779 of 2020.

Learned counsel appearing on behalf of the petitioner submits that petitioner has been granted pre-arrest bail

Patna High Court CR. MISC. No.47759 of 2021(2) dt.25-08-2021 2/2 on 23.03.2021 passed in Criminal Miscellaneous No. 34779 of 2020 with a direction to surrender before the court below within a period of four weeks on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Siwan, in connection with Mairwa P.S. Case No. 79 of 2020, but, due to some unavoidable circumstances, petitioner could not surrender before the Court below within the stipulated time.

In such view of the matter, let the time to surrender of the petitioner as ordered on 23.03.2021 passed in Criminal Miscellaneous No. 34779 of 2020 be further extended by four weeks from today.

Accordingly, the modification application is allowed and the order dated 23.03.2021 passed in Criminal Miscellaneous No. 34779 of 2020 is modified to the above extent.

This application stands disposed of.
