JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-12-2021 Heard Mr. Mahendra Thakur, learned counsel for the petitioner and Ms. Anita Kumari Singh, learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Singhwara P.S. Case No. 02 of 2020 registered for the offence punishable under Section 364(A) of the Indian Penal Code 1860.

This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 9.7.2021 passed in Cr. Misc. 40293 of 2020. The only ground which has been raised by the petitioner for grant of bail is that subsequent to the rejection

Patna High Court CR. MISC. No.47946 of 2021(3) dt.22-12-2021 2/3 of the bail application of the petitioner, a co-ordinate Bench of this Court has granted bail to co-accused Ravi Ranjan Kumar @ Ravi Ranjan Singh in Cr. Misc. No. 27834 of 2021.

This Court while rejecting the earlier bail application of the petitioner on 9.7.2021, has passed a detailed order on merit after taking into consideration the submission advanced by learned counsel for the petitioner also, that one Amrendra Kumar Singh, on whose confessional statement, the name of the petitioner appeared in this case, has been granted bail by this Court in Cr. Misc.29480 of 2020.

After having heard learned counsel for the parties, this Court is satisfied that no fresh material has been brought on record by the petitioner for consideration of his second bail application. The petitioner was identified in the Test Identification Parade by the victim boy who was kidnapped and kept in the house of the petitioner for ransom and after about two and half months in captivity, the victim boy was rescued by the Police, I am not inclined to entertain the bail application of the petitioner at this stage.
