Learned counsel for the respondents raised preliminary objection that in view of Section 34 of the Armed Forces Tribunal Act, 2007 this writ petition is not maintainable. The petitioner has got alternative remedy. The order was passed at Mumbai. After some argument, learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to present the petition before appropriate authority. Prayer is allowed.

The writ petition is dismissed as withdrawn.
