The petitioner apprehends his arrest in Muzaffarpur Complaint Case No.468 of 2017 registered under Sections 420, 467, 468 and 120B of the Indian Penal Code.

The complainant alleged that he purchased Sonalika tractor from the firm of the petitioner in krishi mela on assurance to get subsidy of Rs.50,000/-. The complainant also paid Rs.57,000/- but the petitioner in collusion with the District Agriculture Officer issued receipts showing the purchase of the tractor much prior to holding the agriculture mela for the farmers and that is why the complainant was not paid subsidy amount for purchase of tractor.

The learned counsel for the petitioner submits that

The complainant purchased the tractor from the showroom of the petitioner but immediately thereafter the receipt was issued. No interpolation was made in the receipt. The complainant lodged this case only with a view to pressurize the District Agriculture Officer and the petitioner to grant subsidy.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Complaint Case No.468 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
