The State is represented by Mr. Binay Krishna, learned Special Public Prosecutor.

The appellant has challenged the order dated 27.07.2021, passed by the learned Court of Special Judge (SC/ST Act)-cum-Additional District and Sessions Judge - 1st, Nawada, in A.B.P. No. 802 of 2021, arising out of Rajauli P. S. Case No. 284 of 2021, whereby the prayer made on behalf of the appellants for grant of anticipatory bail for the offences punishable under

Patna High Court CR. APP (SJ) No.3411 of 2021(4) dt.01-11-2021 2/2 Sections 302/120(B) of the Indian Penal Code; Section 27 of the Arms Act, 1959; and Section 3(ii)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, has been rejected.

After some arguments, learned counsel for the appellant seeks permission to withdraw this petition in order to enable the appellant to surrender before the court below and seek bail.

Should such an application be filed, it shall be considered on its own merits, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court.

Dismissed as withdrawn.
