The petitioner apprehends his arrest in a case under Section 307 and other sections of the Indian Penal Code. The informant Manoj Kumar Lal named the petitioner along with other accused persons and alleged that on the order of Laxmi Lal, the petitioner assaulted the informant with Farsa on his head. Other accused persons are alleged to have assaulted the informant and other accused persons. It is submitted that there is a counter-version being Singhwara P.S. Case No. 258 of 2014. Umesh Lal, the petitioner, lodged the case which was registered under Section 308 and other sections of the Indian Penal Code. Umesh Lal made statement in D.M.C.H., Darbhanga in injured condition. It is further submitted that the occurrence took place due to land dispute. The petitioner

Patna High Court Cr.Misc. No.8916 of 2015 (2) dt.04-03-2015 2/2 is alleged to have assaulted the informant with Farsa on his head but the injury found on the head of the informant is simple in nature as the same would appear from Annexure-2/A. The informant got another injury of fire arm, which is opined to be grievous on account of fracture of bone.

Considering the facts that on account of land dispute, the occurrence took place, and on account of the assault made by the petitioner, simple injury is caused, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Manjhi, Judicial Magistrate, Muzaffarpur in Katra P.S. Case No. 170/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
