====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-09-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 1324-C of 2016 for the offence punishable under Sections 498A of the Indian Penal Code and Section 4 of the D.P. Act.

Notice was issued to O.P. No.2 and the same has validly been served but no one has put appearance on behalf of O.P. No.2.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is

Patna High Court CR. MISC. No.36658 of 2020(4) dt.13-09-2021 2/2 innocent and has not committed any office. In fact, the coaccused having more or less similar allegation has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 10.08.2017 passed in Cr. Misc. No. 38117 of 2017 and the case of this petitioner stands on similar footing. Hence, the petitioner may be granted the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the, above named, petitioner in the event of his arrest or surrender before the court below within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bettiah, West Champaran in connection with Complaint Case No. 1324-C of 2016 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
