JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 13-05-2015 Supplementary affidavit filed on behalf of petitioner has been kept on record.

Heard learned counsel for the petitioner as well as learned APP for the State assisted by the learned counsel for the informant.

There happens to be allegation against the Mukhiya/petitioner along with her husband as well as Panchayat Sevak who have misappropriated Government money to the tune of Rs. 10 Lakhs.

By way of supplementary affidavit Annexure-4 series has been filed wherefrom it is evident that some sort of irregularities were found by the District Magistrate, Aurangabad with regard to working pattern relating to item no.9/2012-13 as well as item no. 11/2012-13 whereupon petitioner had to deposit

Patna High Court Cr.Misc. No.13761 of 2015 (2) dt.13-05-2015 Rs. 25,390/- which the petitioner has already deposited. Furthermore, it is evident that her husband has already been granted bail vide Cr.Misc.No. 6717/2015, Panchayat Sevak, Birendra Kr Ram has been granted anticipatory bail vide Cr.Misc.No.9406/2015.

In the aforesaid facts and circumstances of the case, petitioner, Renu Devi, in the event of her arrest/surrender within four weeks, is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Aurangabad in Jamhor PS Case No. 98/2014, subject to the condition as enumerated under Section 438(2) of the Cr.P.C.
