JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2016 Heard learned counsels for the petitioner and learned APP for the State as also learned counsel for the Bihar Electricity Board.

The present application has been filed for quashing of the First Information Report of Tajpur P.S. Case No. 41 of 2016 registered under sections 135 of the Electricity Act, pending in the court of the learned CJM, Samastipur.

The accusation is of consumption of electric energy unauthorizedly.

It is submitted by learned counsel for the petitioner that the petitioner has already deposited the loss calculated amount and is ready for compounding of the offence.

Patna High Court Cr.Misc. No.21496 of 2016 (2) dt.05-08-2016 2/2 Mr. Sanjay Kumar Giri, learned counsel for the Bihar State Electricity Board submits that the Board has no objection in disposing of the compounding proceeding under section 152 of the Electricity Act provided such prayer is made by the petitioner.

Hence, this application is disposed of. It is expected from the North Bihar Power Distribution Company Limited to conclude the compounding proceeding within a period of three months of the filing of such application by the petitioner. (Dinesh Kumar Singh, J) Anil/- U T
