JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 09-01-2018 The present writ petition has been filed for issuance of an appropriate writ, order or direction quashing the order dated 10.07.2017 contained in memo no. 327 issued by the Sub-divisional Officer, Katihar, whereby the PDS licence of the petitioner bearing no. 04 of 2001 has been suspended due to institution of FIR against the petitioner under Section 7 of the E.C. Act.

2. At the very outset learned counsel for the petitioner submits that it will suffice if the petitioner is permitted to approach the District Magistrate, Katihar (Respondent No. 2) with a fresh representation for redressal of his grievances raised in the present writ petition, in which event, the present writ petition need not be pressed

3. Learned counsel for the respondents appears and has been heard.

4. Having regard to the nature of the grievances and the stand of the petitioner, the present writ petition is disposed of granting liberty to the petitioner to file a fresh representation before the District Magistrate, Katihar (Respondent No. 2) for redressal of his grievances. If any such representation is filed within a period of two weeks from today, the same shall be considered and disposed of expeditiously and preferably within a further period of eight weeks thereafter in accordance with law.
