Petitioner is in custody in connection with Habibpur P.S. Case No. 90 of 2020 for the offence under sections 341, 323, 448, 354(B)/504/506/34 of the Indian Penal Code and Section 8/12 of the Pocso Act.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
Allegation against this petitioner is that he has tried to outrage the modesty of the informant. The petitioner and the informant are co-villagers.
The petitioner is in custody since 27.6.2020. Learned counsel submits that parties have entered into compromise. He refers Annexure-2 in this regard.

No.36554 of 2020(2) dt.30-01-2021 2/2 Considering fact that the petitioner and the informant are co-villagers and parties have entered into compromise, although the offence is not compoundable but for the purpose of bail the compromise between the parties may be relevant factors and as such, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VI, Bhagalpur cum Special Judge (Pocso) Act, in connection with Habibpur P.S. Case No. 90 of 2020.
