JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-06-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1, namely, Vinod Yadav @ Binod Yadav was arrested during pendency of this anticipatory bail petition and, accordingly, his prayer for anticipatory bail became infructuous.
So far as petitioner no. 2, namely, Manoj Yadav is concerned, he is not named in the first information report and after going through the case diary, I find that except suspicion, there appears to be nothing against him.
Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioner no.
Patna High Court Cr.Misc. No.15055 of 2015 (4) dt.30-06-2015 2, namely, Manoj Yadav, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, Judicial Magistrate 1st Class, Jamui in Chandradeep P.S. Case No. 71 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
