ANJANA MISHRA ORAL ORDER 27-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Dulhin Bazar P.S. Case No. 150/2013 registered for the offences punishable under Sections 467, 468, 471, 420, 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that one of the accused persons namely Nand Kumar, in his confessional statement made before the Police, has stated that the petitioner used to procure guns, makes forged licences and supply them to other prospective buyers.

Learned counsel for the petitioner submits that such statement made before the Police has no evidentiary value. He

Patna High Court Cr.Misc. No.7438 of 2015 (3) dt.27-04-2015 further submits that petitioner has also been made accused in Dulhin Bazar P.S. Case No. 149 of 2013 registered under Section 25(1-b) a, 26 of the Arms Act arising out of the same occurrence. Considering the aforementioned submissions and also the submission made on behalf of the learned counsel for the State that save and except the aforesaid confessional statement, there is no other cogent evidence on record or in the case diary so as to implicate the petitioner, let the petitioner, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, Patna, in connection with Dulhin Bazar P.S. Case No. 150/2013 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
