The petitioner, who is in custody since 26.06.2020 seeks bail in connection with Lalganj P.S. Case No. 235 of 2018 dated 03.07.2018, G.R. No. 3267/18, instituted for the offences under Sections 379 /34 of the Indian Penal Code.

In the First Information Report, the accusation is that the petitioner was identified as one of the miscreants, who had robbed the informant.

Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.35734 of 2020(2) dt.19-01-2021 2/2 that no recovery has been made from the petitioner and he was not even arrested on the spot. Merely because his background is tainted, he has been named in this case. Regard being had to the nature of accusation and period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IX, Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 235 of 2018 dated 03.07.2018, G.R. No. 3267/18.
