JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-11-2022 The present writ petition was dismissed earlier by an order dated 05.10.2018 on account of non-prosecution, however, the same was restored subsequently to its original file by an order dated 25.07.2022, passed in M.J.C. No. 5331 of 2018.
Today, when the case has been called out, nobody has bothered to appear before this Court for the petitioner, however, a bare perusal of the prayer made in the present writ petition would show that the present writ petition has been filed for directing the learned Principal Judge, Family Court, Madhubani to dispose off the matrimonial case bearing M.M. No. 233 of 2015, C.Reg No. 559 of 2015, which is an application filed by the petitioner under Section 13 of the Hindu Marriage Act, 1955, expeditiously.
Having regard to the limited prayer made by the petitioner in the present case, this Court grants liberty to the petitioner to approach the learned Court of Principal Judge, Family Court, Madhubani to pursuade the
Patna High Court CWJC No.16100 of 2017(3) dt.07-11-2022 2/2 learned Court below to dispose off the aforesaid case of the petitioner, expeditiously, if the same has not already been disposed off. The writ petition stands disposed off on the aforesaid terms. (Mohit Kumar Shah, J) Tiwary/Saurav U
