The petitioner is in judicial custody in connection with S. Tr. No. 572 of 2021 arising out of Bind P.S. Case No. 64 of 2021 for the offences under Section 307 of the Indian Penal Code and Section 27 of Arms Act, later on added Section 302 of IPC.

As per the prosecution story, the informant's husband namely Lalit Ram was going to his field and when he reached near the house of Bhola Pandit, the petitioner started abusing him. On protest, the petitioner fired from pistol causing injury to the stomach of Lalit Ram and he was injured and brought to

Patna High Court CR. MISC. No.39130 of 2022(2) dt.30-09-2022 2/2 PHC for treatment. Accordingly, the present FIR instituted. There is direct allegation against the petitioner of opening fire causing injury in the stomach of the deceased which was fatal.

Considering the specific allegation that has made, this Court is not inclined to grant him any relief and bail application is accordingly rejected.

The Trial Court is directed to expedite the trial and conclude the same preferably within a period of one year. (Rajiv Roy, J) Ravi/Ajay Singh U T
