JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with SC/ST Banka Police Station Case No. 14 of 2014 registered for the offences punishable under Sections 147, 341, 323, 447, 384, 386, 504 and 506 of the Indian Penal Code.
The above named seven petitioners are named in the first information report with accusation that they stopped the informant from digging the foundation of his house and not only demanded Rs. 50,000/- and odd in rangdari but also humiliated him calling
Patna High Court Cr.Misc. No.10614 of 2015 (2) dt.19-03-2015 2/2 his caste name.
The contention on behalf of the petitioners is that there was land dispute between the parties and as a matter of fact, much prior to institution of the present case, petitioner no. 1 had lodged a case before Surpanch, Gram Panchayat and after that he also lodged case before officer in-charge of Barahat police station. Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, taking note of this fact that the alleged occurrence took place on account of land dispute and not because of caste of the informant ,let petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in SC/ST Banka Police Station Case No. 14 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
