JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 19-05-2016 Heard the counsel for the petitioner and AC to SC -10 for the State. After having heard both sides, this Court finds that the anticipated grievance of the petitioners is spelt out in paragraph 10 which reads as under:- "10. That recently there had been widening of road by the PWD and in spite of my opposition the contractor in connivance with the officials has laid hume pipes on my land and sewage of the adjoining areas is supposed to flow in my land."

In my view, the petitioner should be permitted to raise a grievance in this regard for consideration and disposal by the appropriate/competent authority. The counsel for the petitioner submits that the District Magistrate of the district is in overall charge of such construction work taken up by the Public Works Department/Road Construction Department at the local level. The writ application stands disposed of permitting the petitioner to approach the respondent District Magistrate ventilating the aforesaid grievance

Patna High Court CWJC No.8296 of 2016 dt.19-05-2016 2/2 for consideration and disposal in accordance with law. If any such representation is filed, needless to observe, the District Magistrate may make appropriate inquiry, if deemed necessary, and pass appropriate order in accordance with law on the said representation, preferably within one month from the date of filing thereof.
