It has been alleged by the complainant/informant that she had purchased 4.5 decimal of RSP No.362 from Renu Devi. When she applied for mutation, she came to know that mutation was already running in name of accused Shrikant Kumar, Mita Kumari on the basis of the sale deed executed by the petitioner Sudhir Sharma, on the basis of forged and fabricated power of attorney allegedly executed by aforesaid Renu Devi.
It has also been alleged that in the aforesaid background of 05.06.2014 she was assaulted and further Rs.2000/-, wrist watch was snatched away by the accused persons. Renu Devi did not come in fray and on account thereof, the genuineness of the power of attorney having in favour of petitioner Sudhir Sharma remained unexplained and that being so, petitioners Sudhir Sharma, Niranjan Sharma
Patna High Court Cr.Misc. No.12273 of 2015 (2) dt.06-05-2015 each are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachia in connection with Naugachia P.S. Case No.165 of 2014 in the event of their arrest / surrender within four weeks in terms of condition so laid down under Section 438(2) Cr.P.C.
