The petitioner being the Panchayat Secretary is apprehending his arrest in a case registered for the offences punishable under Section 406, 409, 420, 120B/34 of the Indian Penal Code.
It is alleged that the Panchayat Secretary and the Panchayat Mukhiya embezzled the Government money to the tune of Rs. 8,28,720/- allocated for purchase of solar light. Moreover, the solar lights were not purchased either from BELTRON and BREDA.
It is submitted by the learned counsel for the petitioner that the purchase was made in the year 2006-07 but the First Information Report has been lodged in 2014. At the time of purchase there was no such direction to purchase the solar lights only from BELTRON and BREDA. The enquiry has
Patna High Court Cr.Misc. No.7681 of 2015 (2) dt.26-02-2015 been made after six years of purchase.
Considering the fact the co-accused Arti Devi the Panchayat Mukhiya has been granted bail vide Cr. Misc. No. 1539 of 2015, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Simri P.S. Case No. 194 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
