In the instant application, the petitioner seeks modification of order, dated 16.10.2015, passed in Cr. Misc. No. 43771 of 2015, by which the time granted by the learned Sessions Judge for payment of 20% of the value of un-milled rice not supplied was extended to six months with a further condition that he would not absent himself for two consecutive dates at stretch, till framing of charge.

Learned counsel submits that as the amount to be deposited is heavy, four months further time is sought for depositing the said amount. He submits that the petitioner has already deposited a sum of Rs. 2,00,000/- (two lacs). In view of the facts and circumstances of the case, the

Patna High Court Cr.Misc. No.18856 of 2016 (3) dt.29-03-2017 2/2 time for depositing the balance amount is extended by further four months from today. The petitioner should deposit a sum of Rs.50,000/- (fifty thousand) within one month and the rest within four months from today.

This application stands allowed.
